The Little Traverse Bay Bands of Odawa Indians, who live on tribal lands in Michigan, are now the third tribe to pass a marriage equality statute. Last July, a similar act was introduced but lost by one vote. Speaking at that time in favor of the new statute was Ken Harrington, a former Chairman of the Odawa council:
“We have our own constitution, our own court system, and our own government, police force [and], Department of Natural Resources, so it’s our right to express equality. In my mind, we’re all equal in our creator’s eye.”

The tribe will now recognize and perform same-sex marriages. Two tribes – the Coquille of Southern Oregon and the Suquamish of Washington State – have already passed similar measures. Those tribal decisions set off a concerted effort by the group Indigenous Ways of Knowing, who issued an LGBT equality toolkit last fall. “Tribal Equity Toolkit: Tribal Resolutions and Codes to Support Two Spirit and LGBT Justice in Indian Country,” is a legal guide which helps tribal leaders strengthen and promote equality. IWOK pledges to continue its work until all tribes recognize and perform marriages of Two-Spirit people.

In Native American tradition, sexuality was viewed differently than it was by the encroaching Europeans. Most tribes recognized different “kinds” of gender: the Navajo accepted 4 but other tribes had even more. The most common description is “two-spirit” – men with feminine tendencies or women with masculine ones. The Indians recognized that, for one to be in harmony with themselves and the world around them, they needed to be able to live with a balance of male and female.“Unlike the European cultures, most of the American Indian cultures recognized that sexuality was a continuum. Sexuality was not male or female, but included a full range of feelings and expressions. Thus, individuals who did not fit into the male or female concepts were not only accepted by society but were able to maintain their internal harmony and balance.” (Source)This was perfectly acceptable in Native society, and in some tribes these Two-Spirit people were viewed as sacred.
