and so it begins....

Yesterday on my public Facebook page, I began following the story of Eden Foods (this is a good place to start), an organic food company whose products are beloved by many friends, especially my vegetarian and vegan friends (they make beans and soy milk, among other products).

In 2013, the company and their chairman and sole shareholder, Michael Potter, sued the federal government for the right to deny contraceptive coverage to their employees. Here's the court filing.

The plaintiffs, Eden Foods, Inc., and Michael Potter, appeal from a denial of their request for a preliminary injunction that would forbid federal agencies from enforcing that mandate against them. They contend that offering such contraceptive services to the employees of Eden Foods would substantially burden the plaintiffs’ religious beliefs.

Potter refers to contraceptives as "lifestyle drugs." He has compared buying birth-control pills to Jack Daniels. He believes that "Obama's in your bedroom" and that he a defender of freedom, and has also characterized Obama as a dictator. Moreover, he actually can't identify which religious principle in particular leads him to object to providing birth control.

Two things interest me here. First, I have my doubts whether an organic food company can survive a boycott from progressives. Whole Foods has managed to be an anti-union corporation with CEO who likes to go on Obama-is-a-fascist rants (speaking as a historian, this is not what fascism looks like) and yet still thrive.

Second, I am always interested in the way that white wealthy Christians present themselves as victims

(my public writing is coordinated under the general heading of "language, power, and privilege."). There is power in simultaneously claiming righteous might while also under assault by powerful and nefarious forces. It's an old rhetorical move and remains widely spread among the American Christian right (see my CNN.com piece on Sarah Palin at the NRA). In response to the outrage at their position, Eden Foods has gone on the defensive-offense.

Dear David,

Eden Foods is a principled food company. We were convinced that actions of the federal government were illegal, and so filed a formal objection. The recent Supreme Court decision confirms, at least in part, that we were correct. We realized in making our objection that it would give rise to grotesque mischaracterizations and fallacious arguments. We did not fully anticipate the degree of maliciousness and corruption that would visit us. Nevertheless, we believe we did what we should have.

The objection we filed has never been part of the Hobby Lobby lawsuit.

 Note that I never mentioned Hobby Lobby.

this is the kind of actions that start reactions and remind corporations that they are not the final word and they are subject to the same discriminations they practice against Americans in the name of their religious claims except we don't call it discrimination we call it boycotting, that is when you don't hear the people or the Ca- Ching as often.  will you save as much as you lose?

America's most prominent teen mom and walking demonstration of the failure of conservative abstinence notions Bristol Palin knows just how to say thank you to Hobby Lobby for protecting their employees from the fires of hell. (Well, or at least making sure the company gets to save a few bucks—the premise is still a bit fuzzy.) With a hashtag, of course! And so today marks Palin's announced #HobbyLobbyLove day, a day that sounds pornographic but is in fact merely a day to take pictures of yourself buying cheap imported crap from a company that puts the womenfolk in their proper place.

But much like abstinence education, Twitter hashtags often do not work out quite as conservatives plan they might. #HobbyLobbyLove is having a rough go of it.

Reason #1 SCOTUS Will Regret Hobby Lobby

After oral arguments in the Hobby Lobby case, I wrote a very misnamed but widely read diary in which I echoed Attorney and Ring of Fire radio host Mike Papantonio's argument that the SCOTUS would never rule in favor of Hobby Lobby for a really Big Business reason: It pierces the corporate veil.

If Hobby Lobby's owners can give their Corporation religion, their religion gives Hobby Lobby's owners--and any other owner, shareholder, officer, whatever--liability for the actions of the corporation.  Mr. Papantonio, who happens to be one of America's preeminent trial lawyers, sees it as an opportunity to sue owners for the company's negligence.  

I'm luvin' this already if true we should start seeing the real blowback on that decision to further infuse corporations with more powers that individual American citizens don't have.

That separation is what legal and business scholars call the "corporate veil," and it's fundamental to the entire operation. Now, thanks to the Hobby Lobby case, it's in question. By letting Hobby Lobby's owners assert their personal religious rights over an entire corporation, the Supreme Court has poked a major hole in the veil. In other words, if a company is not truly separate from its owners, the owners could be made responsible for its debts and other burdens.

"If religious shareholders can do it, why can’t creditors and government regulators pierce the corporate veil in the other direction?" Burt Neuborne, a law professor at New York University, asked in an email.

That's a question raised by 44 other law professors, who filed a friends-of-the-court brief that implored the Court to reject Hobby Lobby's argument and hold the veil in place. Here's what they argued:

Allowing a corporation, through either shareholder vote or board resolution, to take on and assert the religious beliefs of its shareholders in order to avoid having to comply with a generally-applicable law with a secular purpose is fundamentally at odds with the entire concept of incorporation. Creating such an unprecedented and idiosyncratic tear in the corporate veil would also carry with it unintended consequences, many of which are not easily foreseen.

I wonder if the court right wing side realized this and if not should they be allowed to interpret our laws any longer.  after all this is big in respect to what it appears they were trying to do that being empower the corporate entity they say are people now is coming back to bite them.  these decisions of late hopefully will lead to a reform of scotus tenure and limit their time on the bench, how many better people have we loss by holding on to old guys out of tune and some of questionable character.

we do need to take the country to a different place there is no back because it has always been as it is an oligarchy, just because they are not in office legally does not prevent their directing those politicians in the way they want America to go, with very little consideration of what "we the people" want, money talks while American families walk.

A Fox & Friends segment on Monday warned women looking to succeed in business “not to raise their voices” and not to talk too much.

Fox News host Steve Doocy introduced Sylvia Ann Hewlett’s book, Executive Presence, by advising that women should wear “well-cut jeans with a colorful top,” while an on-screen graphic told them “not to raise their voices.”

Co-host Anna Kooiman, however, argued that “women shouldn’t be so focused on what we look like, and what we’re wearing, but what our mind can do.”

“Also a little thing that you think is important is your presentation and your voice,” co-host Brian Kilmeade added. “Keep it low, don’t speak loud.”

“For women,” Doocy emphasized.

Hewlett explained that a lot of women from the South were taught to “fill the air with words… but oftentimes that undermines you, just rambling.”

“Don’t talk too much,” Doocy recommended.

“Exactly,” Hewlett agreed. “Interestingly, men commit a lot of these mistakes, not just women. And there are some particular hurdles for people of color.”

 this is republican for "you are nothing but eye candy and your potential lecherous boss will judge you as the whore you probably look like so tone it down keep him out of trouble".  so you must do these things to satisfy the knuckle dragging chauvinist in men to get a job, but what after you get it then what are you expected to do all those things they told you not to to get thev job now become must do's to keep it right wing exertion of control over the women they are at war with.

John Boehner Can’t Name One Example Of Obama Breaking The Law In 12 Paragraph CNN Op-Ed

Speaker of the House John Boehner spent twelve paragraphs writing about why he must sue President Obama, but what was missing from his CNN commentary was any examples of Obama breaking the law.

Boehner wrote, “But too often over the past five years, the President has circumvented the American people and their elected representatives through executive action, changing and creating his own laws, and excusing himself from enforcing statutes he is sworn to uphold — at times even boasting about his willingness to do it, as if daring the American people to stop him.”

That sounds dangerous, so what has the president done?

Boehner continued, “That’s why, later this month, we will bring legislation to the House floor that would authorize the House of Representatives to file suit in an effort to compel President Obama to follow his oath of office and faithfully execute the laws of our country.”

This is another allegation that the president has broken laws, but which laws did he violate?

The Speaker continued to ramble on without offering the slightest hint of specifics, “Even worse, the President’s habit of ignoring the law as written hurts our economy and jobs even more. Washington taxes and regulations always make it harder for private sector employers to meet payrolls, invest in new initiatives and create jobs — but how can those employers plan, invest and grow when the laws are changing on the President’s whim at any moment?

 I don’t take the House legal action against the President lightly. We’ve passed legislation to address this problem (twice), but Senate Democrats, characteristically, have ignored it.”

Network Sunday Shows All Ignore Strong Jobs Report And Record Stock Surge

When is the U.S. economy not a topic worth addressing on the Sunday morning talk shows? Apparently when there's lots of good news to discuss.

At least it seemed that way this past Sunday when all four of the network Sunday morning talk shows ignored last week's surprisingly strong jobs report, which indicated nearly 300,000 news jobs were created in the month of June. Consequently, the unemployment rate fell to 6.1 percent, the lowest level since September 2008.

The jobs surge meant America had logged its highest January-through-June job-growth rate since 1999. (The U.S. has added 1.4 million jobs since December, making it the best half-year since the recession ended.) And over the past 52 months of jobs growth, businesses have created nearly 10 million jobs.

Also ignored by all the Sunday hosts and guests was the fact that the Dow Jones stock exchange on Thursday for the first time surpassed the 17,000 mark, "another in a string of records for the index that has lifted portfolios in a five-year bull market for stocks," according to the Associated Press. Indeed, "The Dow has climbed more than 10,500 points since its Great Recession low of 6,547.05 on March 9, 2009."

I understand Fox and even CNN but NBC and the rest this is why I say we can no longer depend on media to keep us informed they are like our politicians they take a paycheck and don't deliver.  that is bad as Fox by telling us nothing they are letting all we heard all week and on their shows stand with a hardy big thumbs up. 

we are the ones that hold the purse strings those of us they denied jobs or unemployment extensions could that be why we are seeing the dismissal by the right wing of what they say and do, they think they have neutralized enough of us with their denials that we no longer have the power of numbers?  this is pilling up giving you plenty to consider Nov. 4th in case you are still fence walking.

if not hearing of the Pres.'s accomplishments is driving his numbers down don't depend on biased polls or biased rhetoric if you are reading this you have access to the internet explore.  we must come together for our own greater good.

Hobby Lobby wanted to block Doctors from even Talking to you about Contraception

The thing that I keep hearing from people who support the Hobby Lobby decision tends to be things like "Well, you don't have to work there" and that "Can't you afford $9/Month to buy your own Pills?" but the thing they don't seem to realize is that Hobby Lobby wasn't just trying to avoid paying for Birth Control methods they considered to be "abortiafacient" - they wanted to block them from being able to Consult with their Doctor about them.

Arguments in front of the Supreme Court start next week in the Hobby Lobby case. Hobby Lobby is suing for a religious exemption from the Department of Health and Human Services mandate requiring that employer-provided health insurance cover contraception. Most of the coverage of the case has focused on Hobby Lobby's objection to the contraception itself and how, if the business prevails, its employees will have to pay out of pocket for things like birth control pills or IUDs.  

But, as Tara Culp-Ressler at ThinkProgress explained on Wednesday, Hobby Lobby and their co-plaintiff, Conestoga Wood Specialties, are also objecting to insurance plans covering "related education and counseling" for contraception. In other words, these for-profit businesses aren't just asking their female employees to pay for their own contraception, even though they are already paying for their own contraception by paying for their insurance coverage. These companies want to elbow their way into doctor's offices and call the shots on what doctors can and cannot say to Hobby Lobby and Conestoga Wood employees.

And that my friends, now the Supreme Court has held in favor of Hobby Lobby is an entirely different kettle of Gefilte Fish than we've been told so far.

Most medical providers have basically been on the sidelines in the big reproductive healthcare fight of the modern era—abortion. Maybe because it's too politically charged for them to really engage in, since fewer and fewer providers are actually involved in providing that critical service, or it just hasn't seemed relevant to their professional lives. But now the Supreme Court has started to creep onto their territory, and they are not happy.

The 5-4 decision was immediately criticized by the American Medical Association, the American Nurses Association (PDF), the American Academy of Family Physicians and the American College of Obstetricians and Gynecologists for allowing employers to meddle in the exam room.

The decision “intrudes on the patient-physician relationship and will make it more difficult for many women to make their own personal medical decisions,” said Dr. Robert Wah, president of the AMA. “We encourage the administration to provide alternative pathways to secure coverage for patients unable to obtain these services as a result of the court's ruling.”

Each of the groups urged officials in Washington to work quickly to restore coverage options for all insured women, saying that limiting insurance coverage would force women to take additional steps or pay out of pocket for birth control—which affects low-income women in particular.

wasn't the republican side claiming ObamCares would come between you and your dr.?  once again right wing shows it knows more than doctors or women especially when it come's to their healthcare and what's best or they were just lying again and denying again it really takes those of unscrupulous characterless mindsets to impose their will when they are not of the gender of those they are trying to regulate.  so far congress and the rest of them are ignoring those who know and those who need.

I fail to see how it turned into a split vote with the right wing side defending the right wing which is less than half of the country.  a vote for the people is not suppose to guarantee big business it's way it's suppose to dispense fair and just decisions, regardless to what could be as far as women getting  contraception it does the same as citizens united who let anybody bid on our country this allows any owner who wants to deny or control or save a buck to do so regardless to legitimacy of their claim, that is high court looking out for high business not the people.

great follow up to last post.

We do too much "heroification" in America, according to James W. Loewen, author of Lies My Teacher Told Me: Everything Your American History Textbook Got Wrong (one of his several books that ought to be on everybody's shelf). Like me, he thinks the word hero has been cheapened, ending up more often a description for football quarterbacks who throw perfect last-minute passes than for, say, the passerby who risks her own life to pull a child from a flooding river.

Heroification describes what textbooks, too many teachers, and the likes of Lynne Cheney have done to historical figures such as the deeply racist Woodrow Wilson and a multitude of other notable Americans. The process of heroification not only turns the notorious into role models while many people who actually deserve the praise they get are turned into one-dimensional stereotypes without flaws. As if we couldn't stand to see our heroes as human beings who don't always get things right, who, in fact, sometimes behave deplorably and hypocritically.

Despite his flaws, my number one personal hero is—and has been since I was introduced at age 14 to his autobiography—Frederick Douglass, the runaway slave whose persistent eloquence was one of the leading factors persuading Abraham Lincoln to bring black soldiers into the Union Army. Without those 180,000 men who ultimately fought, quite literally, for freedom, it is uncertain that the Union would have survived.

But Douglass was deeply unhappy with Lincoln in 1860, labeling him “an excellent slave hound” because of Honest Abe's support for the Fugitive Slave Act that required authorities in non-slave states to turn over runaways to their owners, or rather, most usually to bounty hunters. Once taken, the runaways were returned whence they came or often sold "down river," where a short life of overwork in the coastal cane fields or elsewhere awaited them.

Lincoln's Inaugural address sparked a ferocious critique from Douglass, who repeated the "slave hound" accusation. He was disgusted that the president had spent several paragraphs of that address argumentatively defending the practice of returning slaves, even repeating the Constitution's “shall be delivered up” phrase in regard to the human property the South had enshrined as their right for being part of the Union in the first place.

 In Douglass' view, the effect of Lincoln's trying to hang onto slave states to save the Union by turning over runaways was tantamount to killing them since a captured runaway's life was usually very short. Lincoln was, Douglass said with that slave-hound label, no different than the dogs sent to sniff out and corner a runaway until the master came to collect him. Pretty strong stuff to characterize the guy who would become known as The Great Emancipator.

if this is to be believed Lincoln was not the man we read about in history books it would also explain why the right wing still embraces him and refers to itself as the party of Lincoln.  also does this give a different insight into republicans as to why they have engaged in this heroification for those who are less than honorable, to present a more favorable picture of those before them, if that's so then why did they get worse in their treatment and rhetoric  another case of them hating and not knowing why they rewrite to pretty up their past and drop elephant dung bombs on their future, party of stupider?

If Our Founding Fathers Were All Christians, Why Did They Say This?

Nobody can deny the fact that Christianity has played a huge role in our history. From the first Thanksgiving to the ideas of Jesus Christ that are embroidered in our culture today, Christianity and the Bible is responsible a big part of our heritage.

However, many conservatives will take this fact way out of context. They'll think that you have to be a Christian to be patriotic, which is simply not true. Following the more secular teachings of Jesus Christ (being charitable, loving one another, treating strangers with kindness) is what the men who founded this country were for.

I don't want to waste my time listing all these obscurant far-right arguments, so instead I'll list the facts straight from our forefathers.

we've seem many instances where history was not written exactly as it happened was this done so those in charge could feel better about themselves or were they ashamed?  the right wing loves to say what those founding guys intended much like they love to tell Americans not White what they really want, need, think and why they are like they are, while all the long falsifying the reality.

 I meet you all the time. You hate Obama. You hate gay people. You hate black people, immigrants, Muslims, labor unions, women who want the right to make choices concerning their bodies, you hate em all. You hate being called racist. You hate being called a bigot. Maybe if you talked about creating jobs more than you talk about why you hate gay people we wouldn't call you bigots. Maybe if you talked about black people without automatically assuming they are on food stamps while demanding their birth certificates we wouldn't call you racist. You hate socialism and social justice. You hate regulations and taxes and spending and the Government. You hate.

     You like war. You like torture. You like Jesus. I don't know how in the hell any of that is compatible, but no one ever accused you haters of being over-committed to ideological consistency. You like people who look like you or at least hate most of the things that you hate. You hate everything else.

Now, I know you profess to love our country and the founding fathers (unless you are reminded that they believed in the separation of church and state), but I need to remind you that America is NOT what Fox News says it is. America is a melting pot, it always has been. We are a multi-cultural amalgamation of all kinds of people, and yet you still demonize everyone who is not a rich, white, heterosexual christian male or his submissive and obedient wife.

You hate liberals, moderates, hell, anyone who disagrees with Conservative dogma as espoused by Fox News and Rush Limbaugh. You hate em.

Well, here are the facts, Jack. If you hate the Government then you are unqualified to manage it. If you hate gay people more than you love America than you should take your own advice and get the hell out. There are several countries that are openly hostile to gay people, but they are full of brown people and you don't like them much either from what I understand. It looks like you are screwed, but that's not what I am here to tell you.

Now that you have thrown everything and the kitchen sink at President Obama and it still hasn't worked you are panicking. Obama's approval ratings are still near 50% despite your best efforts to undermine the economy and America's recovery at every step you can. You tried to hold the American economy hostage to force America into default on its' debts, debts that YOU rang up under Bush, so you could blame it on Obama and it failed.

You've used the filibuster more than any other Congress ever, going so far as to vote against providing health care access to 9/11 first responders. Thom Tillis is stuck at the state capitol trying to resolve a budget quarrel as speaker of the North Carolina House. It's a spot that helps Hagan emphasize Tillis' role leading a Republican-controlled state government that Democrats contend has gone overboard with conservative zeal by restricting access to abortion and the voting booth while cutting corporate taxes and slashing spending on schools.

Drinking coffee this past week from a hand-grenade-shaped mug in his no-frills legislative office, he's got his own message in his campaign to take Hagan's Senate seat. "Obamacare," he said, "continues to be a big problem."

Similar themes are playing out in other crucial Senate races, as voters have four months to decide which party will control the chamber in the final two years of Barack Obama's presidency. For Republicans, it's all about tying Democrats to Obama — especially to a health care law that remains unpopular with many Americans. And for Democrats, the election is about just about anything else, especially if they can steer attention away from Washington and federal matters.

why do they keep saying so many oppose the ACDA when stats show that so many more embrace and praise it?  we are being short changed by media on both sides the republican side we know is full of misinformation misleading's and out right bald faced lies, while the Progressive side is quite and gives us cricket sounds when it comes to squaring up the truth when their interviews and stories are mostly rebuked long ago but to those who come late the silence is tantamount to a thumbs up.

Obama dares GOP: 'Sue me'

President Obama on Tuesday defended his use of executive actions and dared critics to stop him as Republicans weigh a legal challenge to his powers.

"Middle-class families can't wait for Republicans in Congress to do stuff," Obama said defiantly during a speech in Washington. "So sue me.

"As long as they do nothing, I'm not going to apologize for doing something," the president continued.

Obama made the comments as House Speaker John Boehner (R-Ohio) considers a lawsuit against the president over his use of executive actions.

Obama has issued a number of executive actions, working to bypass Congress and push his agenda, including measures raising the minimum wage for federal contract workers and deferring deportations for many young illegal immigrants.

Those decisions have Republican critics accusing him of executive overreach, but the president has said that he can't wait for Congress to act on many of the nation’s problems.

kudo's to Pres. it's worth it to call their bluff America's future is at risk he is the Pres. he honors his oath of office they can't make the same claim.  what the other half of the country fails to grasp is the overlying issue is the failure of republicans to honor their oath, saying no and going on TV and saying your number one hob is to make this Pres. fail and proceed to do nothing for 6 years and have the audacity of arrogance to sue him for doing his hob and theirs, and the right wing base is just as blind as a bat with it's eyes poked out if they can see that.

Obama blamed the infrastructure funding standoff solely on Republicans in Congress, saying they "have refused to act" on his idea to use corporate tax reform savings to pay for transportation projects.

"Republican obstruction is not just some abstract political stunt," he said. "It has real and direct consequences for middle-class families all across the country. 

"I haven't heard a good reason why they haven't acted [on transportation funding]," Obama continued. "It's not like they've been busy with other stuff."

The Koch Brothers Are Using Fox News Employees As Campaigners

At least 15 Fox News hosts and contributors have recently campaigned with two political organizations created and heavily funded by billionaire industrialists Charles and David Koch. Many of those same Fox News personalities have also defended the Kochs from attacks and praised their political efforts on-air.  

The controversial conservative brothers founded the 501(c)(4) group Americans for Prosperity (AFP) and its 501(c)(3) sister group the Americans for Prosperity Foundation (AFPF) in 2004. David Koch has called AFP the group he feels "most closely attached to and most proud of" and chairs AFPF's board. (The Washington Post notes of the IRS code distinction: "A 501(c)(4) is allowed to do considerably more issue advocacy work than a 501(C)(3), however. Neither group has to disclose the identity of its donors or the amounts of money those contributors have given.")

is there really any surprise here?  we know they are trying to but America they want to confuse us with campaigning but it's buying by any bother name and it wreaks of elephant dung.

Politico's Ken Vogel reported that AFP "intends to spend more than $125 million this year on an aggressive ground, air and data operation benefiting conservatives, according to a memo distributed to major donors and sources familiar with the group." The Washington Post wrote that with a paid staff of 240, split between 32 states, AFP "may be America's third-biggest political party." In 2012, "More than $44 million of the $140 million the organization raised in that election cycle came from Koch-linked feeder funds."

AFP and AFPF are part of a massive $400 million network of political groups spearheaded by the Kochs. The Huffington Post's Paul Blumenthal noted, "It is the electoral focus of the Koch nonprofits and their sophisticated efforts to shield donors' identities -- plus the vast sums of money they move -- that has brought them the unwanted attention of both Democratic Senate leadership and reporters. There exists no outside network or organization supporting Democratic Party candidates in elections, while not disclosing its donors, that spends money in comparable amounts."

Supreme Court rules against home care workers unions

The Supreme Court's decision in Harris v. Quinn, the case challenging fair share fees for unionized home care workers, is bad, but it could have been worse. The case involved the significant danger that the Court would take the chance to eviscerate all public employee unions by forcing unions to provide services for non-union workers for free; currently non-union workers covered by union contracts must pay a fair share fee to cover the costs of the representation they personally receive. However, the decision authored by Justice Samuel Alito is limited to undercutting home care workers specifically:

The Court recognizes a category of "partial public employees" that cannot be required to contribute union bargaining fees. [...]

It remains possible that in a later case the Court will overturn its prior precedent and forbid requiring public employees to contribute to union bargaining. But today it has refused to go that far. The unions have lost a tool to expand their reach. But they have dodged a major challenge to their very existence.

American Embassy officials in Baghdad sided with Blackwater rather than the State Department investigators as a dispute over the probe escalated in August 2007, the previously undisclosed documents show. The officials told the investigators that they had disrupted the embassy’s relationship with the security contractor and ordered them to leave the country, according to the reports.

After returning to Washington, the chief investigator wrote a scathing report to State Department officials documenting misconduct by Blackwater employees and warning that lax oversight of the company, which had a contract worth more than $1 billion to protect American diplomats, had created “an environment full of liability and negligence.”
