Justice Antonin Scalia is not a big fan of gay sex, gay marriage, or gay anything. His dissent to Wednesday's decision on United States v. Windsor, in which the Supreme Court ruled, 5-4, that legally married same-sex couples should get the same federal benefits as straight ones, shows as much.
(The high court's ruling invalidates a provision of the Defense of Marriage Act that barred same-sex couples from receiving health, tax, and retirement benefits.) In a nutshell, Scalia's dissent focuses on the Court's prime purpose and power, and he is aghast that the majority assumed the power to shoot down DOMA. - "That is jaw-dropping. It is an assertion of judicial supremacy over the people's Representatives in Congress and the Executive. It envisions a Supreme Court standing (or rather enthroned) at the apex of government, empowered to decide all constitutional questions, always and everywhere 'primary' in its role."
"F" the people in congress and that is a lot nicer than what they have been doing to us, but we are progressives.
no it shows the court embracing the wishes of the majority devoid of hate and bigotry, he can always retire if he doesn't like ruling in favor of the people.
And the kicker:
it's a terrible thing to say some will despair at another Americans ability to realize their pursuit of happiness in the country supposedly known for it's equality and freedoms as the right likes to say but never except.
